(b)(10) Electronic Health Information (EHI) Export Requirement

If you’re a health IT developer or compliance professional, the requirements of (b)(10) Electronic Health Information (EHI) export criteria are likely top-of-mind. But do you know where you stand regarding the looming year-end compliance mandate?

Any certified Health IT product that electronically stores EHI must be certified to the Cures Update 170.315(b)(10) EHI Export criterion by the end of 2023. The requirements include:

  • Single Patient EHI Export:
    • Export EHI at any time the user chooses without developer assistance
    • Includes all EHI for a single patient to the extent that it would be included in a designated record set as defined in 45 CFR 164.501.
    • Created in a timely fashion
    • Electronic and in computable format
    • Limit users who can perform an EHI Export
    • Provide a publicly accessible hyperlink of the export’s format
  • Patient Population EHI Export
    • Includes all EHI for a patient population
    • Electronic and computable format
    • Provide a publicly accessible hyperlink of the export’s format
  • Live testing is not required to meet the (b)(10) criterion for exporting EHI. Rather, developers are required to submit an attestation to their ONC-ACB. If a third-party solution is utilized to help meet the (b)(10) requirement, developers must still attest to their ONC-ACB and update their certification listing. PLEASE NOTE: Your (b)(10) Attestation must be submitted to Drummond no later than December 1, 2023 in order to meet the ONC Deadline.
